Digital Millennium Copyright Act Notice & Takedown Policy
1. Introduction
Neer Social ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. This Digital Millennium Copyright Act ("DMCA") Policy outlines our procedures for responding to notices of alleged copyright infringement in accordance with the DMCA (17 U.S.C. § 512).
If you believe that your copyrighted work has been copied or used in a way that constitutes copyright infringement on Neer Social, please follow the procedures set forth below to submit a notification.

3. Filing a DMCA Takedown Notice
If you are a copyright owner, or authorized to act on behalf of one, and you believe that your copyrighted work has been infringed on Neer Social, you may submit a written DMCA takedown notice to our designated agent. Your notice must include all of the following:
- Identification of the Copyrighted Work: A description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the Infringing Material: A description of the material that you claim is infringing and that you want removed or access disabled, with enough detail for us to locate it. This includes the username/display name of the account, the specific content (e.g., profile photo, bio text, event description), and any relevant screenshots or URLs.
- Your Contact Information: Your full legal name, mailing address, telephone number, and email address so that we may contact you regarding your complaint.
- Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy Statement: A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
- Signature: A physical or electronic signature (typing your full legal name is acceptable) of the copyright owner or a person authorized to act on the copyright owner's behalf.
4. How We Process Takedown Notices
Upon receiving a valid and complete DMCA takedown notice, Neer Social will take the following actions:
- Prompt Removal: We will act expeditiously to remove or disable access to the allegedly infringing material.
- Notification to User: We will notify the user who posted the allegedly infringing material that it has been removed or disabled, along with a copy of the takedown notice.
- Record Keeping: We will retain a copy of the takedown notice and our response for our records in accordance with applicable law.
5. Filing a Counter-Notification
If you believe that material you posted on Neer Social was removed or disabled by mistake or misidentification, you may file a counter-notification with our designated agent. Your counter-notification must include all of the following:
- Identification of the Material: A description of the material that was removed or disabled, and the location at which the material appeared before it was removed or disabled (e.g., your username/display name, the type of content).
- Good Faith Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Middle District of Florida if you reside outside the United States), and that you will accept service of process from the person who provided the original takedown notice or an agent of such person.
- Your Contact Information: Your full legal name, mailing address, telephone number, and email address.
- Signature: Your physical or electronic signature (typing your full legal name is acceptable).
6. Counter-Notification Processing
Upon receiving a valid counter-notification, Neer Social will:
- Forward to Complainant: Promptly provide the original complainant with a copy of the counter-notification and inform them that the removed material may be restored in 10 business days.
- Restore Material: Restore the removed material within 10 to 14 business days after receiving the counter-notification, unless the designated agent first receives notice from the original complainant that they have filed a court action to restrain the user from engaging in the infringing activity.
7. Repeat Infringer Policy
Neer Social has adopted and implements a policy for the termination, in appropriate circumstances, of users who are repeat infringers of copyright. Our repeat infringer policy includes the following measures:
- First Offense: The infringing content will be removed and the user will receive a formal warning via in-app notification explaining the violation and the consequences of further infringement.
- Second Offense: The infringing content will be removed and the user's account will be temporarily suspended for a period determined by Neer Social at its sole discretion.
- Third Offense: The user's account will be permanently terminated and the user will be prohibited from creating new accounts on Neer Social.
Neer Social reserves the right to terminate any account at any time if the user is determined to be a repeat infringer, regardless of the number of prior warnings.
8. Types of Content Covered
This DMCA Policy applies to all user-generated content on Neer Social, including but not limited to:
- Profile photos and images
- Bio text and profile descriptions
- Event titles, descriptions, and images
- Any other content uploaded, posted, or shared by users through the Service
9. Misrepresentation Warning
Please be advised that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
Before filing a DMCA takedown notice, please carefully consider whether the use of the copyrighted material at issue is protected by the "fair use" doctrine, as you could be liable for costs and attorneys' fees if you knowingly misrepresent that the material is infringing.
10. Accommodation of Standard Technical Measures
Neer Social accommodates and does not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works, as defined under the DMCA. We will not disable or circumvent technological measures that copyright owners use to protect their works.
11. Safe Harbor
Neer Social qualifies as a "service provider" under the DMCA and maintains the protections available under 17 U.S.C. § 512. We do not manually review or editorially control user-generated content before it is posted, although automated filters may flag or prevent content that violates our Community Guidelines. As such, we rely on copyright owners to notify us of any infringement through the procedures described in this policy.
12. Governing Law
This DMCA Policy is governed by and construed in accordance with the laws of the United States, specifically the Digital Millennium Copyright Act (17 U.S.C. § 512), and the laws of the State of Florida. Any disputes arising under or in connection with this policy shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida.
13. Changes to This Policy
Neer Social reserves the right to modify this DMCA Policy at any time. Changes will be effective when posted on this page with an updated "Last Updated" date. We encourage you to review this policy periodically. Your continued use of Neer Social after any changes constitutes your acceptance of the updated policy.
